ANALISIS HUKUM PERBANDINGAN PENERAPAN THEORY DETERRENCE DALAM PENANGANAN KASUS KORUPSI DI INDONESIA DAN CHINA
Abstrak
Corruption is an extraordinary crime requiring effective criminal policies capable of producing deterrent effects. This study analyzes the application of Deterrence Theory in handling corruption cases in China and Indonesia based on severity, certainty, and celerity. This research uses normative legal research with statutory, conceptual and comparative approaches. The findings show China applies deterrence more effectively through severe punishment, strong legal certainty, and swift enforcement, while Indonesia faces challenges in sentencing consistency and deterrent effectiveness. The study concludes that deterrence effectiveness depends not merely on punishment severity but also on certainty and swiftness of law enforcement.
